Bar fight seems to be settled out of court

The fight over the location of a bar in the middle of Rolling Oaks seems to have fizzled as a preliminary agreement has been reached by both parties and is likely on the way to a formal settlement agreement.

“We are relieved,” Rick Dodson, who was one of the property owners in Rolling Oaks who had signed onto the request for injunction, said. “If it goes ahead and happens the way it looks like it is going to it will be over, and we’ll be back pretty much to where we were when it started.”

Before a court case for a temporary injunction could be heard, the owners of Wenty’s Wine and Beer Yard met with attorney David Junkin, who was retained by Rolling Oaks residents, to come to terms.

The preliminary agreement states that the owners of the property will “refrain from constructing any structure or improvement… for the purpose of operating a business or commercial enterprise” as well as agree that they will explicitly not operate a business that sells alcohol on the property.

“It is not over until a settlement agreement is signed, but I do expect that the highlights of the settlement agreement will be the (main) points of the Rule 11 agreement,” Junkin said.

Dodson said the attention of the residents is now turning to preventing such scenarios from happening again in the future.

“We had a few very intense weeks,” Dodson said. “Everybody here is happy, and the next step for us is to figure out what we need to do to make sure this isn’t something that happens again.”
