Powers of eminent domain for pipelines

Whenever a “utility” uses the powers of eminent domain, there are existing provisions in the Texas Constitution for that private entity to follow regarding oversight of route choices, construction, management, relations with the private property owners and targeted communities at large.

Eminent Domain is a government granted power, and by it’s nature, must be overseen by that government granting that power. Otherwise, you have a private entity, gone rouge with government power and no oversight.

Permian/Kinder is using the Utility Code to enforce eminent domain, while using the absence of “natural gas” in statute to subvert oversight by Texas government in all Permian/Kinder’s practices.

Currently Hays County and City of Kyle seek a temporary injunction until mandates are followed. There are lots of misconceptions about this case; it’s not about stopping the pipeline, but merely asking Permian/Kinder to follow rules that all other “utilities” do.
